REGISTRATION: TERMS & CONDITIONS
Responsibility: The Playboy Scramble, produced by Playboy Golf/I.D. LLC (“Producer”) - and offical licensee of Playboy (PEI), has selected highly qualified tour operators; golf courses, vendors (collectively “Suppliers”) to organize and administer the local Playboy Scramble tournament (“Event”). The designated Suppliers in turn, provide there own aspect of the program providing goods and or services such as transportation, hotel accommodations, golf activities, etc in connection with this Event. The Suppliers are solely responsible and liable for providing their respective services. Passenger tickets in use by the participants of this Event shall constitute the sole contract between the carriers and the passenger; the carriers are not responsible for any act, omission, or event during the time tour participants are not aboard their conveyances.
Liability: Producer and its designated shall not be held liable for (A) any damage to, or loss of, property or injury to, or death of, persons occasioned directly or indirectly by an act or omission of any Supplier, and (B) any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent, thereof, or by acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause(s) beyond Producers control. The participant waives any claim against the Producer and/or its designated Supplier for any such loss, damage, injury, or death. Producer shall not be liable for any air carrier’s cancellation penalty incurred by the purchase of a nonrefundable ticket to or from the participant’s departure city. Baggage and personal effects are at all times the sole responsibility of the participant.
Basis of Rates: The rates are based on current tariffs and are subject to change due to unforeseen circumstances. While we will do everything possible to maintain the listed prices, if it is necessary to levy a surcharge we reserve the right to do so, and notification will be given at the time of final invoicing.
Event Price Includes: All entrance fees; services of Producer staff; Access to casting calls (where applicable), VIP Pre Party, one (1) round of golf including greens fees and cart rental; and any taxes and service charges as indicated in the itinerary.
Not Included: Hotel, Air transportation and related fees (except as indicated in itinerary); airport transfer ground transportation; baggage/accident/cancellation insurance; personal expenses, such as laundry, telephone calls, meals, alcoholic beverages; and any other items not specifically noted as included.
Cancellations and Refunds: Producer reserves the right to cancel the Event because of inadequate enrollment that makes the event economically unfeasible to operate. In such a case, a full refund of the Event cost will be made. An Event may be rescheduled at the sole discretion of the Producer and its Suppliers due to acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause(s) beyond Producers control. Producer will have no liability for rescheduled airline tickets or hotel due to an Event being cancelled or rescheduled. Leaving an Event in progress, for any reason whatsoever, will not result in a refund, and no refunds will be made for any unused portions of the Event. Trip cancellation insurance is strongly recommended and advised. Once you or your team decides to register, all registrations are final and payment is due upon registration. Please make sure that you are able to attend or have someone substitute for you or your team if you cannot attend. There are no refunds once you submit your registration.
Decline Admission: Tournament, Playboy Golf Casting calls and Parties. Producer at its sole option, reserves the right to decline admission to or remove any attendee or guest(s) from the Events it deems to have a negative impact upon Events, Playboy, sponsor(s), attendees or guest(s).
Itinerary Changes: The itineraries presented in this Event are subject to modification and change by the Producer or its designated Supplier. Every reasonable effort will be made to operate programs as planned, but alterations may still occur after final itineraries are sent. Finals itineraries will be faxed or emailed upon request.
Health Requirements: By registering for the Playboy Scramble, the participant certifies that he/she does not have any mental, physical, or other condition or disability that would create a hazard for him/herself or other participants. Any physical condition requiring special attention must be reported in writing when the reservation is made. Producer and its designated Suppliers reserve the right to decline to accept any person as a participant of an Event or to require any participant to withdraw from an Event anytime when such action is determined to be in the best interest of the health, safety, and general welfare of the Event participants as a whole or the individual participant.
Payment: No Spots are held. Payment IN FULL is due upon registration and all registrations are FINAL. Submitting your registration acknowledges you agree to the terms and conditions and understand that there are NO REFUNDS except as referenced above in Cancellations and Refunds.
PROPRIETARY RIGHTS
You acknowledge and agree that all content and materials available on this site are protected by copyrights, trademarks, service marks, patents, trade secrets, or other proprietary rights and laws. Except as expressly authorized by PRODUCER & PEI , you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from such materials or content. Notwithstanding the above, you may print or download one copy of the materials or content on the DOWNLOADS section of this site on any single computer for your personal, non-commercial use, provided you keep intact all copyright and other proprietary notices. Systematic retrieval of data or other content from this site to create or compile, directly or indirectly, a collection, compilation, database or directory without written permission from PRODUCER & PEI is prohibited. In addition, use of the content or materials for any purpose not expressly permitted in these Terms of Use is prohibited. As noted above, reproduction, copying, or redistribution for commercial purposes of any materials or design elements on this site is strictly prohibited without the express written permission of PRODUCER & PEI.
LIMITATION OF LIABILITY
UNDER NO CIRCUMSTANCES SHALL PRODUCER & PEI, ITS SUBSIDIARIES, OR ITS LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THIS SITE. THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF AMERICA ONLINE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, PRODUCER\'S AND PLAYBOY\'S LIABILITY IN SUCH JURISDICTIONS SHALL BE LIMITED TO THE EXTENT PERMITTED BY LAW.
INDEMNIFICATION
Upon a request by PRODUCER & PEI, you agree to defend, indemnify, and hold harmless PRODUCER & PEI and its subsidiary and other affiliated companies, and their employees, contractors, officers, and directors from all liabilities, claims, and expenses, including attorney\'s fees, that arise from your use or misuse of this site. PRODUCER & PEI reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with PRODUCER & PEI in asserting any available defenses.
SEVERABILITY AND INTEGRATION
Unless otherwise specified herein, this agreement constitutes the entire agreement between you and PRODUCER & PEI with respect to this site and supersedes all prior or contemporaneous communications and proposals (whether oral, written, or electronic) between you and PRODUCER & PEI with respect to this site. If any part of these Terms of Use is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.
TERMINATION
PRODUCER & PEI reserves the right, in its sole discretion, to terminate your access to all or part of this site, with or without notice.
